What You Should Know

Title IX is a federal civil rights law that prohibits discrimination on the basis of sex, including sexual harassment, in federally funded education programs and activities. Title IX addresses sexual harassment, sexual violence, and other forms of sex-based discrimination that deny a person access to educational benefits and activities.

WHEN A STUDENT, EMPLOYEE, APPLICANT, OR OTHER PERSON SEEKING TO ENGAGE IN AN EDUCATION PROGRAM OR ACTIVITY HAS EXPERIENCED SEXUAL HARASSMENT, THE DISTRICT HAS THE OBLIGATION TO STOP THE DISCRIMINATION, PREVENT ITS RECURRENCE AND REMEDY ITS EFFECTS. THIS INCLUDES RETALIATION FROM OTHER STUDENTS, FACULTY, AND STAFF.

Under Title IX, Sexual Harassment is defined as conduct on the basis of sex that satisfies one or more of the following definitions:

(a) Quid pro quo is when an employee of the recipient conditions the provision of an aid, benefit, or service of the recipient on an individual’s participation in unwelcome sexual conduct;

b) Unwelcome conduct is conduct determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the recipient’s education program or activity; or

c) Sexual assault (i.e., forcible rape, forcible sodomy, sexual assault with an object, forcible fondling, incest, and statutory rape) dating violence, domestic violence, and stalking.
